Obama's Attorney General Is At It Again

December 2009

Despite great public and congressional opposition, Attorney General Eric Holder insists on trying self-proclaimed 9-11 mastermind Khalid Sheikh Mohammed and 4 other Guantanamo Muslim terrorist detainees in a civilian federal courthouse blocks from the site of their devastating terrorist destruction of the New York World Trade Center, killing almost 3,000.

Twin Towers fall in New york

Holder also announced that five others including a major terrorist "suspect" in the bombing of the USS Cole, Abd al-Rahim al-Nashiri, will be tried separately, but before a military commission. No understandable reason for his "split prosecutions". Holder is the very same Deputy A.G. who, under Clinton, was responsible for the pardons of several FALN Puerto Rican terrorists who declared war on the U.S., and also for the pardoning of fugitive billionaire, felon Marc Rich, among his other previous notable acts. I believe if Truman were here today, Holder would favor prosecuting him for war-crimes in the WWII A-bombing of Hiroshima and Nagasaki civilians.

Many in the media have cited very important reasons against trying 5 of these mass-murderous terrorists as criminals in our Civil Courts but others as enemy combatants in military tribunals. Included will be serious and costly security problems for New York in trials that these war-time terrorists will undoubtedly use as an "International forum" against "evil America". The highly publicized prosecution of these mass-murderous terrorists will be a protracted US "judicial circus" - a media event far surpassing that of the "OJ trial" that exonerated the killer. It will last many months, and will result in a hung jury if less than a unanimous 12 to 0 decision. Just one "hold-out" jurist, and it's a "hung jury". As for Holder wanting "death penalties", we should all know what "death penalties" mean. With almost 700 on "death row" in California, we've had but 14 executions since 1963! And, in a "hung jury" scenario, the federal prosecutors must either retry cases, or possibly even free the mass-murderous terrorists. (Where would they go?) Further, if convicted and given "life sentences", they might join dedicated Jihadists in prison and other anti-US convicts.

In the current case of traitor US Army Major Nidal Malik Hasan who killed 13 and wounded 29 last week at Fort Hood, Texas, (i.e., 42 "murderous acts") some in the liberal media (and ACLU) feel he should also be prosecuted as a criminal -- though he's an Islamic-American terrorist with Jihad connections. His subversive, seditious behavior while serving as an Army psychiatrist (via his free half million dollar medical training) should warrant prosecution for Treason in addition to mass murder. But will our permissive administration?

Dr Garber is Director of the American Civil Responsibilities Union, Inc. In 1981 he was Southern California Director of the first recall effort to oust Chief Justice Rose Bird and 2 other justices. Bird had reversed 61 of 61 death penalty convictions. (She was appointed by Governor Jerry Brown in 1977 -- now Attorney General in California).
